Terms of Service
1. Agreement
These terms apply to your use of kaelnovus.com and any publicly accessible endpoint served under that domain (together, the "Site"). By accessing the Site you agree to these terms. If you do not agree, do not use the Site.
2. Operator
The Site and the Kael Novus project are operated by Andre Dempsey, sole trader, based in Brisbane, Queensland, Australia. References to "we", "us", and "the project" throughout these terms refer to that sole operator.
3. Nature of the service
The Site is the artist's public presence and the OAuth callback endpoint for the artist's own publishing tools. It does not provide an interactive service to the general public. There is no account sign-up, no user-generated content, and no third-party posting capability.
Content visible on the Site — including music, artwork, written transmissions, and branding — is produced by the artist for the artist's own release schedule and may change or be removed at any time without notice.
4. Acceptable use
You agree not to:
- Attempt to gain unauthorised access to the Site, its hosting infrastructure, or any connected platform account.
- Scrape the Site in a way that imposes unreasonable load on the hosting provider.
- Use the Site to transmit malware, phishing content, or unlawful material.
- Impersonate Kael Novus or the operator, including by reusing branding, handles, or cover art.
- Circumvent any technical or legal restriction on the Site or on the artist's connected platforms.
5. Intellectual property
All original content on the Site — including but not limited to music, lyrics, cover art, photographs, copy, and the visual identity — is owned by the artist or licensed to the artist. No licence to reuse, reproduce, or distribute that content is granted by your visit to the Site.
Fair-dealing uses recognised under Australian copyright law (for example, review, criticism, or parody) are not affected by this clause.
6. Third-party platforms
The Site links to external platforms such as TikTok and Instagram, and the artist's publishing tools interact with those platforms' APIs to publish the artist's own content. Your use of those platforms is governed by their own terms of service and privacy policies. The artist is not responsible for those platforms' availability, moderation decisions, or data handling.
7. Disclaimer of warranties
The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, the artist disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these terms is intended to exclude or limit any rights you have under the Australian Consumer Law that cannot lawfully be excluded.
8. Limitation of liability
To the maximum extent permitted by law, the artist will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site. Where liability cannot be excluded, it is limited to the resupply of the Site or, at the artist's option, the cost of resupply.
9. Termination
The artist may suspend or discontinue the Site, or any part of it, at any time without notice. These terms will continue to apply to any use that occurred before suspension or discontinuation.
10. Governing law
These terms are governed by the laws of Queensland, Australia, and the Commonwealth of Australia where applicable. Any dispute arising from these terms is subject to the non-exclusive jurisdiction of the courts of Queensland.
11. Changes to these terms
When these terms change, the "Last updated" date at the top will move. Continued use of the Site after a change indicates acceptance of the revised terms.
